What do we do when justice turns a blind eye towards you?  How is it possible for a life to change in a matter of minutes into a nightmare?  Image this... Two young people fall in love, marry and start a family, then within 5 years all of that is destroyed by an obsessed mother-in-law.  What happens when a group of people go on an innocent fishing trip and a man falls into the water and drowns?  The nightmare begins.
On a vast Texas Panhandle lake on the overcast, windy pre0dawn morning of Saturday, April 9, 1994, two fishermen traveled in a motor-powered rubber raft to check trot lines.  The night was dark, the moon lost behind a cover of clouds.  An intoxicated young man falls from the boat and drowns leaving a young wife and two small children.  At last the obsessed mother of the drown man sees a way to obtain custody of the oldest much coveted grandchild if only she can create a murder out of her sons death.  She hires a ruthless attorney to serve and aid in her obsession.  he files a wrongful death suit against widow and her family.  Mission... get widow out of her way so she can get custody of grandchild.  The woman hounds authorities day and night with her fantasy that her son was murdered.  The state investigates and refuses to bring charges against widow so obsessed woman contacts the FBI.  The federal government investigates and rules NO FOUL PLAY.  the woman is grantic and searches for a pawn to use to help convince FBI of sons murder... who better than the other man from the fishing trip that was the last person to see the deceased man alive... A guy down on his luck with a famil yof his own to take care of and looking for an easy life.  Woman promises man a life of financial gain if he will agree to help her get custody of grandchild.  The plot thickens... The man from the boat is widows own brother!
The brother goes to the FBI and confesses to a murder that didn't happen.  All of the sudden his common law wife receives a car and various other gifts.  She starts attending church with the attorney and his family and stayws with attorneys family while the husband sits in county jail.  A rags to riches story.  The key to all this...
Brother must help secure conviction of his own mother and sister in order to continue to receive promised incentives.  On April 18, 1995, four months after coerced confession, his moher, father and sister are Federally indicted.
Late August, the FEDERAL trial begins.  September 5th conviction on all counts, mission accomplished... woman gets grandchild.  Brother recants testimony and said it was all lies yet judges upholds conviction and ssays to appeal charges to a higher court.  The fathers fedearl charges dropped to a state charge sentenced to 6 months deffered adjudication probation.  The young mother along with her own mother are sentneced each to double life sentence in Federal prison where they will die.  Brother is sentenced to 30 years in Federal prison.  Ruthless attorney paid in excess of a quarter of million dollars.  50.4 million judgement awarded in wrongful death suit to obsessed mother.
The Federal conviction is invalid due to the fact the Federal government lacked subject matter jurisdiction to even charge the women.  In order for murder to be a Federal crime certain elements must exist.
Do you find this intriguing?  How could this happen you ask... Let me tell you because this is my story and what has happened to me.  You see my life was overi n 1994 on April 9, when my husband, Billy Dean Bratcher, drown when he fell from a 9' inflated raft into the  waters of Lake Meredith in the Texas Panhandle.  In my shock and grief that followed little did I know the lies and corruption that would sent me illegally to Fenderal prison to spend the rest of my life waiting to die.
Billy's death was a tragic accident and because of his mothers insistence that foul play was involved the State of Texas thoroughly investigated his death and ruled NO FOUL PLAY.  A polygraph was given by the State of Texas to my brother, Tommy Fine, the only one on the raft with Billy and it also proved that there was no foul play involved and that Tommy had only tried to find Billy when he fell into the water.  The State of Texas  decided not to bring any charges related to this death.
Due to the fact that Lake Meredith became a National Recreation Area in 1990, the FBI also had jurisdiction to investigate the drowning and ruled on his tragic death, also no foul play.  The lake being part of the National Park System does NOT give the Federal Government any power to indict and try criminal offenses ONLY investigative power as it is apparent by Title 16 USC 1a6(e).  Federal civil and criminal jurisdiction has not been preempted within the National Park system since 1976.  The land and water comprising Lake Meredith was private land and the lake is man-made, a part of the Canadian River Relamation Project, authorized by the Act of December 29, 1959, (64 Stat. 1124).  See Silase Mason Co. v. tax Commission 302 US 186, the United States Supreme Court stated "we upheld in accordance with arrangement of the States and National Government the right of the United States to acquire private property for use in the reclamation of arid and semi-arid land and hold its purchases subject to STATE jurisdiction.:  Furthermore there is no legislative act by the State of Texas that allows cession of criminal jurisdiction within the State of Texas to the Federal Government over National Parks and Rec areas.
My trial was a farce, nothing resembling a fair trial, an illegal forum at the end of a witch hunt.  The trial was not only unfair but very unconstitutional, by the standards set out in the United States Constitution.  I have many gounds for relief but they are all time barred, the court ruled and the grounds were never adjudicated.  At the time I believed two of my grounds, jurisdictional, were not subject tot he time bar although the court thought otherwise and would not grant me COA, nor would the higher court grant me admission.  The Federal court simply did not have the power to indict or try me for billy's accident.
Criminal jurisdiction is a very powerful ground that can free me from this nightmare that has span over a decade.  People would rather look the other way than to confront the federal government on my behalf.  I do not want to die here knowing that something this wrong could continue to go on just because i do not have the resources to hire some Dream team to fight for me.  i was indicted and tried under 18 USC 1111, and found guilty of not just first degree but also second degree murder for Billy's death and sentenced to two life sentences never to see my freedom again.  There are present limitations on the United States ability to prosecute for the Fedearl offense of Murder.  There are limited ways to bring a Federal Murder charged about, all others remain under the State jurisdiction.  In other words the Federal Government did not hold the subject matter jurisdiction to prosecute nor hold me thus I should have never have been convicted in a Federal Court.  The State of Texas would not bring charges because there was no evidence of murder because it wasn't murder.  this is a grave abuse of our system that was meant to protect us.  I need help getting my story out and my freedom put back in place.  My life remains on hold; my children are reinforced of how I murdered their daddy, yet I remain optimistic that the truth will prevail and I will get my freedom once again.
In prison I have studied the law books available to me to try and understand what happened knowing that I was innocent yet charged and convicted and sent to prison for the rest of my life.  When I gained a little knowledge it was a real eye opener for me.  See I always believed that the courts were there to uphold the law for right and wrong, not whoever had the most moeny to pay for what they wanted as an outcome.  Now I know what it means when they say justice is blind.
I am asking for your help.  I do not know how else to go about it other than be blunt.  I have some knowledge of how the system works but not near enough strength to obtain my freedom.  I have been in prison for most of my adult life with this conviction.  I beg you do not turn your head to my plight.  I am not your typical convict.  I am wroth a few minutes of your time.  Any information you can share with me or help would be greatly appreciated.  If you or someone you know believes in justice, what is right and understands jurisdiction would you please contact me.  Thank you for your time and help in correcting this in justice.
