To Whom It May Concern,
On March 3, 2006 I was arrested for Discharge of a firearm at a structure and Misconduct involving weapons. I went to trial and found guilty. Given 17 and 6 year sentence. There was no evidence that a gun had been fired. there were 3 brothers, one said I through a rock at a window, once said he seen me fire a shot. They based there whole case on a photo taken a few days earlier with me holding a gun. My attorny never called one witness I wanted. Never gave me full discovery. No bullet was ever found inside the apartment. No casing. They never tested my hand for gun residue. They found a gun, I ordered DNA done on the gun. they found four different DNA's. My DNA wasn't found on the gun. Police Officer's involved in my case was arrested for DUI and the Judge said he don't want the Jury to know about this; plus there was a big thing going on with Officer's from South Mountain Police Station in Phoenix, Arizona. They were involved in crime and an investigation on an officer was killed and believed to have been done by another officer. The Judge didn't give me a fair trial and my Attorney sold me out. I am Innocent. I said i wanted to be present when they pick Jurer's. It's on record, but the Judge let my Attorney waive my rights to not be there. I said i wanted to be there when any Jurer's had any questions. Once again, they made sure I wasn't in the court room. Two questions were asked by the Jury.
1. How many bullets were in the gun?
2. How many bullets did the gun hold?
The Judge told them I can't give you an answer to it; it's not part of the evidence. I found this out once I was in prison reading my trial transcript. The police report said how many bullets were in the gun, all were in it. If they would of let the Jury know these questions, I would have been found Not Guilty cause all bullets were there. I need some help. I could go on and on even the way I was sentenced was illegal. I was found guilty for a dangerous crime. I had two priors but there were for shoplifting. So what they did was sentence me under non-dangerous crime so they could use the "2" priors.
